{"id":1198,"date":"2017-02-10T10:39:19","date_gmt":"2017-02-10T15:39:19","guid":{"rendered":"http:\/\/www.davideriknelson.com\/sbsb\/?p=1198"},"modified":"2017-02-09T14:52:37","modified_gmt":"2017-02-09T19:52:37","slug":"briefly-on-neil-gorsuch-and-compromise","status":"publish","type":"post","link":"https:\/\/www.davideriknelson.com\/sbsb\/index.php\/2017\/02\/briefly-on-neil-gorsuch-and-compromise\/","title":{"rendered":"Briefly On Neil Gorsuch and Compromise"},"content":{"rendered":"<p class=\"p1\">I&#8217;m not super-duper enthusiastic about Neil Gorsuch joining the SCotUS\u2014which is probably not much of a shocker\u2014but some of his writing resonated with me, and I wanted to meditate on that. \u00a0Here&#8217;s a snippet from <a href=\"http:\/\/amzn.to\/2kMQBf2\">his book on assisted suicide and euthanasia<\/a>:<\/p>\n<blockquote>\n<p class=\"p3\"><strong><span style=\"color: orange;\">All human beings are intrinsically valuable and the intentional taking of human life by <i>private persons<\/i> is always wrong<\/span><\/strong>. We seek to protect and preserve life for life\u2019s own sake in everything from our most fundamental laws of homicide to our road traffic regulations to our largest governmental programs for health and social security. We have all witnessed, as well, family, friends, or medical workers who have chosen to provide years of loving care to persons who may suffer from Alzheimer\u2019s or other debilitating illnesses precisely because they are human persons, not because doing so instrumentally advances some other hidden objective. This is not to say that all persons would always make a similar choice, but the fact that some people have made such a choice is some evidence that life itself is a basic good.<\/p>\n<\/blockquote>\n<p class=\"p3\">That orange emphasis is mine, because I agree 100%.<span class=\"Apple-converted-space\">\u00a0 <\/span>I&#8217;ve double emphasized &#8220;private persons&#8221; because Gorsuch uses that to cop out of some things that I find absolutely essential to humanity leveling up from here, but I&#8217;ll let it slide because I believe something else:<span class=\"Apple-converted-space\">\u00a0 <\/span><\/p>\n<p class=\"p3\">I&#8217;ve never seen a human action that was <i>not<\/i> undertaken by a &#8220;private person.&#8221;<span class=\"Apple-converted-space\">\u00a0 <\/span>That private person may have been acting on the orders of the State or a corporation or along the dogma of thier faith, but the actor in the moment\u2014the human holding out the bowl of food, holding out the knife, holding out the gun, holding out the helping hand\u2014has always been a private person <i>choosing<\/i> (perhaps under duress, perahaps in a situation where there are no good choices) to comply or to refuse.<\/p>\n<p class=\"p3\">But that&#8217;s my bit, not Gorsuch&#8217;s, and it&#8217;s beside the point, becasue what I diuscovered in reading this is the following:<\/p>\n<p class=\"p3\">Given these words, Gorsuch and I aren&#8217;t such different people\u00a0(apart from a religious\/superstitious disagreement about what constitutes a &#8220;human life.&#8221;)<span class=\"Apple-converted-space\">\u00a0 <\/span>And the thing is, I would accept living under the Christian supersition that a lump of potentially viable human cells entirely dependent upon staying embedded within the person of another human being\u00a0is somehow a &#8220;unique human life&#8221; if that also meant no more death penety, no more war, no more state application of potentially deadly force, and actually fully funding and implementing\u00a0&#8220;our largest governmental programs for health and social security&#8221; so that folks on these shores don&#8217;t just have an abstract &#8220;right to life,&#8221; but a true and concrete right to a\u00a0<em>decent\u00a0<\/em>life.<\/p>\n<p class=\"p3\">That&#8217;s both a logically consistent trade off, and one whose ramifications I would accept, even thought it would mean putting me in violation of the true and deeply held tenants of my faith.<\/p>\n<p class=\"p3\">But, of course, this\u00a0isn&#8217;t the trade off\u00a0I&#8217;m being offered.<\/p>\n<p class=\"p3\">According to the <a href=\"https:\/\/www.washingtonpost.com\/news\/morning-mix\/wp\/2017\/02\/01\/neil-gorsuch-wrote-the-book-on-assisted-suicide-heres-what-he-said\/?utm_term=.71645f75a102\"><i>WaPo<\/i><\/a> (all the blockquotes in this\u00a0post are from this same article):<\/p>\n<blockquote>\n<p class=\"p3\"><i>[Gorsuch] specifically avoids discussing war and capital punishment, saying they &#8220;raise unique questions all their own.&#8221;<\/i><\/p>\n<\/blockquote>\n<p class=\"p3\">In other words, we&#8217;re back to the cryptic American assertion that <a href=\"http:\/\/www.davideriknelson.com\/sbsb\/index.php\/2017\/02\/wont-somebody-think-of-the-children1-yemen-edition\/\">one murder by one man is horrible and to be avoided at all costs, but thousands upon thousands murdering thousands upon thousands is somehow A-OK<\/a>.<span class=\"Apple-converted-space\">\u00a0 I<\/span>t seems to me this is sort of our\u00a0thing as a nation, right?<span class=\"Apple-converted-space\">\u00a0 <\/span>Your kid steals a candy bar, you ground him.<span class=\"Apple-converted-space\">\u00a0 <\/span>Your kid grows up to make millions stealing people&#8217;s homes, and he&#8217;s a captain of industry.<span class=\"Apple-converted-space\">\u00a0 <\/span><em>#America<\/em><\/p>\n<p class=\"p3\">So there we are:<\/p>\n<p class=\"p3\"><em><strong>All human beings are intrinsically valuable<\/strong> (even ones who don&#8217;t exist)<strong> and the intentional taking of human life is always wrong <\/strong>(except for when the government decides to do it).<\/em><\/p>\n<p class=\"p3\">The <em>Washington Post<\/em> goes on to note:<\/p>\n<blockquote>\n<p class=\"p3\"><i>Gorsuch rejected that view [i.e., U.S. Court of Appeals Justice Posner&#8217;s assertion that there were situations where physician-asssisted suicide should be permitted], writing it would \u201ctend toward, if not require, the legalization not only of assisted suicide and euthanasia, but of any act of consensual homicide.\u201d Posner\u2019s position, he writes, would allow \u201csadomasochist killings\u201d and \u201cmass suicide pacts,\u201d as well as duels, illicit drug use, organ sales and the \u201csale of one\u2019s own life.\u201d<\/i><\/p>\n<\/blockquote>\n<p class=\"p3\">Again,\u00a0sorta interesting that all of these <em>consensual<\/em> things are no-go\u2014because\u00a0all human beings are intrinsically valuable, even the ones who don&#8217;t want to keep being human\u2014but if the state very much against your will decides to <a href=\"http:\/\/www.wnyc.org\/story\/cruel-and-unusual\/\">torture you to death with a crazy nonsense drug cocktail<\/a> . . . well, I don&#8217;t need to belabor the point.<\/p>\n<p class=\"p1\">For what it&#8217;s worth, I was talking to some law school lawyers last week, and the second-hand inside-baseball from them (one of whom has a pal who clerks for Gorsuch) is that the dude is solid, fair-minded, and non-ideoligical when he&#8217;s on the bench\u2014the sorta thing you want in a Supreme Court Justice, I&#8217;m told.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>I&#8217;m not super-duper enthusiastic about Neil Gorsuch joining the SCotUS\u2014which is probably not much of a shocker\u2014but some of his writing resonated with me, and I wanted to meditate on that. \u00a0Here&#8217;s a snippet from his book on assisted suicide and euthanasia: All human beings are intrinsically valuable and the intentional taking of human life &hellip;
